1. Introduction & Agreement to Terms

Welcome to Visiuun! These Terms of Service ("Terms") govern your access to and use of the Visiuun websites, applications (including Nekobox File Hosting), Paster (our pastebin service), content, features, and any other services offered by Visiuun (collectively, the "Services").

By accessing, browsing, or using our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, you must immediately cease accessing and using the Services.

These Terms constitute a legally binding agreement between you ("you" or "User") and Visiuun ("Visiuun," "we," "us," or "our").

You must be at least the age of legal majority in your jurisdiction (typically 18 years or older) to use our Services. If you are under the age of majority but at least 13 years old, you may use the Services only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

Certain features may require account registration. If you create an account, you agree to:

  1. Provide accurate, current, and complete information during registration and keep it updated.
  2. Maintain the security and confidentiality of your account credentials (username and password).
  3. Accept responsibility for all activities that occur under your account, whether or not authorized by you.
  4. Notify Visiuun immediately of any suspected or actual unauthorized use of your account or any breach of security via the contact information provided in Section 20.

You may not use another person's account without their explicit permission. Visiuun reserves the right to suspend or terminate accounts found to be in violation of these Terms, used fraudulently, or inactive for an extended period.

4. Acceptable Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms and all applicable local, state, national, and international laws and regulations. You are solely responsible for your conduct and any User Content you provide while using the Services.

The Services are primarily intended for personal, non-commercial use, unless explicitly agreed otherwise in writing by Visiuun.

5. Prohibited Activities

You expressly agree not to use the Services, including Paster, to upload, store, share, transmit, or otherwise make available any User Content or engage in activities that:

6. Reporting Violations & Content Moderation

Visiuun reserves the right, but has no obligation, to monitor, review, screen, or remove User Content at any time and for any reason, including violation of these Terms, without notice.

If you encounter content or behavior that you believe violates these Terms or applicable law (including illegal content as defined under the EU Digital Services Act), please report it to us immediately.

Report Abuse or Illegal Content:

We take reports seriously and will investigate them promptly. Actions taken may include content removal, warnings, account suspension, or termination, depending on the severity and nature of the violation. Where required by law (e.g., under the DSA for users in the EU), we will provide a statement of reasons for content moderation decisions, subject to legal limitations.

You retain ownership of your User Content. However, by submitting, posting, or displaying User Content (including Paste Content) on or through the Services, you grant Visiuun a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, adapt (e.g., for technical formatting, like generating previews for Paster), publish, publicly perform, publicly display, and distribute your User Content solely for the limited purposes of operating, providing, promoting, and improving the Services, and developing new ones. This license includes the right for Visiuun to make User Content available to other users as permitted by the Services' functionality and your settings (e.g., public pastes).

This license ends when you delete your User Content or your account, unless your User Content has been shared with others who have not deleted it, or where retention is necessary for legal or operational reasons (e.g., backups, compliance, logs).

9. Visiuun's Intellectual Property Rights

The Services and all Visiuun Content are the property of Visiuun or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services and Visiuun Content solely for your personal, non-commercial use in accordance with these Terms.

You agree not to copy, modify, distribute, sell, lease, create derivative works from, decompile, reverse engineer, or otherwise attempt to extract the source code of the Services or Visiuun Content, unless laws prohibit these restrictions or you have our written permission. The Visiuun name and logo are trademarks of Visiuun, and may not be copied, imitated, or used, in whole or in part, without prior written permission.

10. Copyright Policy (DMCA & EU Compliance)

Visiuun respects the intellectual property rights of others and expects users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law (including the U.S. Digital Millennium Copyright Act ("DMCA") and relevant EU directives).

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify Visiuun's designated Copyright Agent. For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work that you claim has been infringed.
  3. Identification of the material that is claimed to be infringing and where it is located on the Service (please provide the specific Paster URL if applicable).
  4. Information reasonably sufficient to permit Visiuun to contact you, such as your address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
  6. A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

Under U.S. law, if you knowingly misrepresent that online material is infringing, you may be subject to criminal prosecution for perjury and civil penalties, including monetary damages, court costs, and attorneys' fees.

For users in the EU, similar procedures apply under relevant national laws implementing the Copyright Directive. Please provide sufficient detail for us to identify and locate the allegedly infringing material.

Visiuun reserves the right to remove User Content alleged to be infringing without prior notice and at our sole discretion. In appropriate circumstances, Visiuun will also terminate a user's account if the user is determined to be a repeat infringer.

11. Feedback

If you choose to provide Visiuun with ideas, suggestions, improvements, or other feedback related to the Services ("Feedback"), you agree that Visiuun is free to use, disclose, reproduce, license, distribute, and otherwise exploit such Feedback without any obligation, restriction, or compensation to you.

12. Third-Party Links & Services

The Services may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Visiuun. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access a third-party website or service from the Services, you do so at your own risk, and you understand that these Terms and our Privacy Policy do not apply to your use of such sites. You expressly relieve Visiuun from any and all liability arising from your use of any third-party website, service, or content.

13. Modifications to the Services & Terms

Visiuun reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Services (or any part thereof, including features of Paster or Nekobox) with or without notice at any time.

We also reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material (as determined in our sole discretion), we will provide at least 8 days' notice prior to any new terms taking effect. Notification may occur via posting the updated Terms on our website, through the Services, or via email to the address associated with your account (if applicable).

It is your responsibility to check these Terms periodically for changes. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Services.

14. Termination

Visiuun may terminate or suspend your access to all or part of the Services immediately, without prior notice or liability, for any reason or no reason, including but not limited to your breach of these Terms (such as by posting prohibited content on Paster).

Specific reasons for termination or suspension may include: (a) violations of these Terms or the Privacy Policy; (b) requests by law enforcement or other government agencies; (c) discontinuance or material modification of the Services; (d) unexpected technical or security issues or problems; (e) extended periods of inactivity; (f) engagement in fraudulent or illegal activities; or (g) conduct deemed harmful to Visiuun, other users, or third parties.

Where appropriate and legally permissible (e.g., as required under the DSA for EU users), we will provide affected users with a statement of reasons for the termination or suspension.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. Visiuun generally has no obligation to retain or provide you access to your User Content after termination, though we may allow a brief period for data retrieval in some cases, at our discretion and where technically feasible.

15. Disclaimer of Warranties

THE SERVICES (INCLUDING NEKOBOX AND PASTER) ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VISIUUN, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

VISIUUN MAKES NO WARRANTY THAT: (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS; OR (E) ANY ERRORS IN THE SERVICES WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR CONTENT SUBMITTED (E.G., TO PASTER) OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM SUCH ACTIVITIES.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VISIUUN, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF VISIUUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR RELATING TO:

  1. YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES (INCLUDING PASTER AND NEKOBOX);
  2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
  3. ANY CONTENT OBTAINED FROM THE SERVICES (INCLUDING CONTENT FROM PASTER);
  4. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT (INCLUDING PASTES); OR
  5. ANY OTHER MATTER RELATING TO THE SERVICES.

UNDER NO CIRCUMSTANCES WILL VISIUUN'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (I) THE TOTAL AMOUNT, IF ANY, PAID BY YOU TO VISIUUN FOR ACCESS TO OR USE OF THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (II) ONE HUNDRED EUROS (€100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE LIMITATIONS SET FORTH ABOVE MAY NOT APPLY TO YOU.

17. Indemnification

You agree to defend, indemnify, and hold harmless Visiuun, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content (such as files uploaded to Nekobox or content submitted to Paster), any use of the Visiuun Content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.

18. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of, or related to, them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of Italy without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the competent courts located in Italy. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

19. Dispute Resolution & Redress Mechanism

We prefer to resolve disputes amicably. Before filing a formal legal claim, please try to resolve the issue by contacting us first using the information in Section 20.

If you disagree with a content moderation decision made by Visiuun (such as removal of a paste or file, or account suspension/termination), you may have the right to seek redress. You can request a review of the decision by contacting us via the methods in Section 20, clearly stating the decision you are appealing, the reasons for your appeal, and providing any relevant supporting information (like the paste/file URL). We will review your appeal and respond within a reasonable timeframe, consistent with applicable legal requirements (such as those under the DSA).

For users in the EU, you may also have the right to select a certified out-of-court dispute settlement body to resolve disputes related to content moderation decisions.

21. Miscellaneous

Additional Personal Terms & Agreements

The following sections outline specific terms related to commissioned works and direct communications with Visiuun. These apply in addition to the general Terms of Service above, specifically to individuals engaging in these particular interactions.

Section 22: Terms for Commissioned Works

By requesting one of my works, you agree to the following conditions:


1. License Grant to Visiuun

You grant Visiuun a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display the created work ("Work") across any medium, including but not limited to social media platforms, websites, and other digital or physical spaces, for the purpose of showcasing examples of work and promoting Visiuun's services. You retain all other rights to the work, including the right to use it for your own portfolio and promotional purposes.

2. Modifications

You acknowledge that Visiuun may need to make reasonable modifications or edits to the Work for technical or platform compatibility purposes. For significant alterations that impact the artistic integrity or intended meaning of the Work, Visiuun will consult with you and seek your reasonable approval. Such approval will not be unreasonably withheld.

3. Promotional Use and Attribution

Visiuun may use the Work for advertising, promotional, or marketing purposes, including the inclusion of the Work in portfolios or exhibitions, and will provide clear and reasonable attribution to you as the creator whenever the Work is publicly displayed or used. You also retain the right to showcase the Work in your own portfolio for promotional purposes, mentioning your collaboration with Visiuun (optional).

4. Compensation & Royalties

As this is a paid commission, you acknowledge and agree that any income derived directly from the commercial licensing or sale of the work by Visiuun shall be fully retained by Visiuun.

5. Public Circulation and Removal

Visiuun is under no obligation to remove, alter, or withdraw the Work from public circulation or digital platforms. However, Visiuun will consider reasonable requests for removal or alteration in cases of proven copyright infringement claims, legal takedown notices, or significant misuse of the Work by Visiuun.

6. Attribution Details

Visiuun will provide reasonable and customary attribution to you as the creator whenever the Work is publicly displayed or used, using your name or username as you provide it. If you prefer to remain anonymous, you must explicitly state this in writing at the time of work delivery.

7. Creative Control (Commissions)

In the case of commissioned works, you understand and agree that Visiuun will provide creative direction and retains final creative control over the project. You will work collaboratively within this direction to create the work to the best of your ability.

8. Commission Dispute Resolution

This commission agreement shall be governed by and construed in accordance with the laws of Italy. We both agree that if any disagreement arises related to this work or this agreement, we will first try to resolve it informally and in good faith through discussion. If we can't resolve it this way, we agree to participate in mediation in Bari to try and find a mutually acceptable solution before considering any legal action. If mediation is unsuccessful in resolving the dispute, then both of us have the right to pursue legal remedies in the appropriate courts of Italy.


Section 23: Direct Communications Policy

By engaging in direct, private communications (e.g., Discord DMs, personal messages) with Visiuun (also known as Visionuse), you agree to the following terms:

1. Protection of Personal Creations

You must not use, reproduce, distribute, or create derivative works based on any personal creations of Visiuun shared in direct communication (including but not limited to characters, products, artworks, designs, or any intellectual property) without express written consent from Visiuun. This includes use on social media, websites, or any commercial/non-commercial platforms.

2. No Unauthorized Usage

You are prohibited from copying, redistributing, or modifying any works created by Visiuun shared privately without prior written consent. Unauthorized use violates these terms.

3. No Commercial Use Without Authorization

Commercial use or monetization of Visiuun's intellectual property shared privately is strictly prohibited without express written consent.

4. Direct Communication Privacy

All direct communications are considered private and confidential. Unauthorized sharing, recording, or distributing of private communications without consent from Visiuun is prohibited and may result in termination of communication and potential legal consequences.

5. Personal Disputes and Conduct

Any personal disputes or issues arising from direct communication must be resolved privately and respectfully. Harassment, threats, or disruptive behavior is prohibited. Visiuun reserves the right to block, report, or sever contact.

6. No Third-Party Involvement

Matters discussed in private communication should not be escalated to third parties without prior mutual consent.

7. Confidentiality

Personal or sensitive information shared during communication is considered confidential. Exercise discretion in what you share. Unauthorized distribution or misuse of private information is prohibited.

8. No Assumption of Liability

Visiuun is not liable for personal misunderstandings or issues arising from voluntary interactions.

9. Final Authority on Communication

Visiuun retains the right to set boundaries and end communication. Persistent unwanted behavior will result in blocking or disconnection.

10. Dispute Resolution and Legal Action (Direct Communications)

Legal disputes arising specifically from direct communication violations will be addressed through direct negotiation first. If unresolved, Visiuun reserves the right to pursue appropriate legal action.

11. Infringement Consequences

Failure to respect these terms may result in legal action, including seeking damages or cease-and-desist orders.

12. Governing Law and Jurisdiction (Direct Communications)

These direct communication terms shall be governed by the laws of the EU. Legal actions may be pursued in Visiuun’s jurisdiction or other appropriate venues.

By engaging in direct communication, you acknowledge and agree to these terms.
